Apple 和 Samsung 之間的專利訟訴已經進行到賠償談判的階段。

Apple 律師週三向陪審團提出該公司希望就 Samsung 專利侵權要求額外的 3 億 8,000 萬美元（約新台幣 112 億 4,080 萬元）損害賠償，不過 Samsung 認為賠償金額應降到 5,200 萬美元（約新台幣 15 億 3,821 萬元）。這項賠償如果通過，將加在 Samsung 已被判決支付的 6 億美元（約新台幣 177 億 4,860 萬元）賠償之上。

「我們已經聽過很多 Samsung 方面的說法，表示沒有會買 Apple 產品，」Apple 律師 Harold McElhinny 表示：「不過 Samsung 其實心裡知道這是個坐二望一的比賽。」

而 Samsung 的律師 Bill Price 則表示：「Apple 要求他們所應得的金額。」他並指出消費者選擇購買 Samsung 手機並不是因為回彈特效，或是其他 Samsung 侵害 Apple 的專利，而是為了追求更大的螢幕、可以移除的電視和 4G LTE 服務等功能。

Apple 和 Samsung 之間的損害賠償爭議是 2011 年 4 月 Apple 控告 Samsung 侵害專利官司的延伸。陪審團在去年 8 月判決 Apple 勝訴，並給予 10.5 億美元的損害賠償。不過主審法官 Lucy Koh 於今年 3 月重審這件官司，重新計算賠償金額，並減去了 4 億 5,000 萬美元的賠償金額。
