一.酒駕違反公共危險罪者.可先持駕照正本至管轄處罰
機關辦理記點或駕照吊扣(銷).並安排道安講習.俟司法
機關判決後再行繳納罰鍰~不會有逾期加罰之虞.

二.酒駕違反公共危險罪章~法院罰金可抵酒駕紅單罰緩.
法院公共危險係屬刑事罰.監理所係屬行政罰.
倘刑事罰款(法院罰金)高於行政罰款(酒駕紅單).
則行政罰不必繳.需持收據與紅單至監理站辦理銷
案手續.

倘低於行政罰.則要補足行政罰款不足部份.
兩則僅擇一高者而罰 (一行為不二罰)
經簡易判決確定(有期徒刑).(拘役)者.罰鍰部分免繳納

(須持判決書至監理機關辦理銷案).
