超商咖啡聯漲重罰案　公平會又敗訴！4大超商不用罰

針對前年4大連鎖超商咖啡漲價一事，公平會裁罰2000萬元，4家超商不服因而與公平會打官司，4日上午台北高等行政法院更審宣判，4家連鎖超商不用罰，公平會又敗訴。

前年統一、全家、萊爾富、OK超商等的咖啡不約而同漲價5塊錢，公平會認定這4家超商違反公平交易法不得為聯合行為的規定，分別罰統一超商1600萬元、全家250萬元、萊爾富100萬元，以及來來50萬元罰鍰，合計共處罰2000萬元。

去年台北高等法院撤銷公平交易委員會對國內4大超商聯合調漲咖啡價格處分案一事，高等法院認為，當時鮮奶價格有漲，因而也連帶咖啡漲價，超商之間有相互競爭關係，才會不約而同漲價，因而判決公平會敗訴，不該開罰。

公平員收到判決書後，又向最高行政法院提起上訴，被最高行政法院撤銷發回，今天上午台北高等行政法院更審仍宣判，4家連鎖超商不用罰，公平會又敗訴。
