偷裝GPS追蹤小王　2徵信業者判刑定讞

【劉昌松╱台北報導】國華徵信公司台中分公司邱姓副總、許姓業務經理前年受託調查1件外遇案時，偷偷在疑似「小王」的車上安裝GPS衛星定位系統，竊錄他人行蹤隱私，最高法院依妨害秘密罪，各判徒刑3個月，得易科罰金9萬元定讞。

判決指出，邱、許2人是在2010年底接到一名男性委託，要徵信社幫忙查他的老婆是否外遇，業者在初步調查後，懷疑黃姓男子是小王，為掌握確實證據，找人在黃男的車上安裝利用行動電話門號發射訊號的定位器，然後在辦公室上網追蹤、竊錄黃男車子的行蹤。

二審認為，邱、許2人不尊重他人的隱私，任意竊錄他人非公開的行蹤，觸犯《刑法》妨害秘密罪，案經上訴最高法院被駁回定讞。
