二度彈劾黃世銘 監委撤案後將再提

檢察總長黃世銘被控涉洩密案，監察院今（19）日下午再召開彈劾審查會，但討論時，有監委認為調查報告不夠全面，沒有提及關說案等，提案監委洪德旋、吳豐山兩人決定撤案，擇期再提。

監察院調查黃世銘涉及監聽、洩密一案，今年11月由吳豐山、洪德旋兩人提出彈劾，卻以5票對5票，未能通過。監察院原定12月10日第二度召開彈劾審查會，但人數不足、沒成會。

今天下午監院再度召開彈劾審查會，共9人出席，剛好達到法定開會人數，但討論時，因有監委認為報告不夠全面，沒有提及關說等部分；有人當場要求提案監委補充資料；而且檢察官評鑑委員會日前決議將黃世銘報由法務部移送監察院的報告，也還沒送來。

吳豐山會後受訪指出，有一些委員認為調查報告不完整，要求補充之後再開會，「所以我們就照內部的規定把它撤回，撤回之後會再提」。

根據監察法規定，「彈劾案經審查認為不成立，而提案委員有異議時，應即將該彈劾案另付其他監察委員9人以上審查，為最後之決定」；亦即如果二度彈劾案未過關，對同一人、同一案由，不得再提案彈劾。

此外，檢察官評鑑委員會14日則決議將黃世銘報由法務部移送監察院，建議撤職。
