色情業不符都計法　業者告官敗訴

【李定宇／新北報導】新北市以往取締住宅區及商業區的色情行業，僅能依社維法處罰嫖客及賣淫女子罰鍰，對於色情業者並無嚇阻作用，之後城鄉局改以都市計畫法裁罰，查獲立即處以罰金，經查獲3次以上斷水斷電不准復業，自去年5月執行以來已查獲37案，其中2案業者不服裁罰提出上訴。
 
新北市城鄉局今表示，上訴結果今年八月及十一月皆判決新北市府勝訴，成為全台首件獲法院支持案例，也強化市府貫徹公權力及維護公共安全之決心。
