借卡變盜刷 男判4月

一名男子年初到醫院探視友人，向友人借「悠遊聯名信用卡」到超商買東西，男子使用完後沒還卡，隔天繼續使用，不但搭計程車、還刷卡買金飾，最後被台北地院以偽造文書、詐欺取財等罪，判處有期徒刑四個月。（潘千詩報導）

判決書指出，今年2月21號晚上，麥姓男子到台大醫院探視住院的友人鄭姓男子。因麥姓男子缺錢，所以向鄭姓男子借用具有電子錢包功能的悠遊聯名信用卡，到院內附設的便利商店購買食物。隔天，麥姓男子竟逾越鄭姓男子授權範圍，未經同意持卡搭乘計程車，還到便利商店與銀樓消費超過新台幣七千元。直到鄭姓男子收到銀行簡訊通知刷卡紀錄，才得知信用卡被盜用，報警處理。

台北地院審理時，麥姓男子坦承犯行，法院認定處觸犯偽造私文書、詐欺取財、以不正方法由收費設備得財產上不法利益等罪。審酌麥姓男子無視友人對他的信任，詐取不法利益或財物，使發卡銀行蒙受財產損失，衡量以後合併判處有期徒刑四個月，可易科罰金。全案可上訴。
