撞府男張德正免押了！高院駁回檢方抗告

張德正駕駛砂石車衝撞總統府一案，台灣高等法院終於在3日鬆口，駁回檢方抗告，讓這一齣歹戲拖棚的抗告戲碼暫時告一段落，卻也創下台灣司法史上首度對同一案件一連召開5次羈押庭的紀錄。

台灣高法院2日中午第4度駁回更裁，要求北院重審，並舉出過去3件也以總統府為犯罪對象的案件，都被裁定羈押，這次卻交保，不符合刑事訴訟的公平原則，無法獲得全民對司法公平原則的信賴。

北院2日晚間7時召開第5次羈押庭，維持原裁定，讓張德正以30萬元第五度交保並限制住居，且增加限制出境、出海，檢方再次提出抗告。北院3日凌晨公布裁定，反駁高院的質疑，指出每個案件案情不相同，是否羈押應看是否符合羈押要件，並非只要以總統府為犯罪對象即認為有羈押必要。

高院合議庭今天指出，張德正從第一次被檢方聲請羈押後，面對北院連續幾天的開庭，都準時出庭，沒有拖延、不到，且考慮張德正負債百萬，還有父母、女兒要照顧，加上目前身心狀況，應無逃亡可能，因此沒有羈押必要，駁回檢方抗告。
