洪案條款定義凌虐　非必要的非人道待遇

【陳亮諭／綜合報導】洪仲丘事件令相關單位重新檢視軍中制度，軍中「訓練」與「凌虐」之間的灰色地帶，行政院會昨通過陸海空軍刑法第44條修正草案，明定軍中凌虐的定義，「非必要的非人道待遇」。

今日出版的《聯合》報導，國防部舉例，兩棲部隊的「天堂路」訓練測驗，若依社會一般觀念，恐已符合凌虐；草案因此新增凌虐定義為「非因教育、訓練、勤務、作戰或其他軍事必要，使軍人受凌辱虐待的非人道待遇行為」。
