維護食安　綠委提案修《食管法》加重罰則

【蘇聖怡／台北報導】為防止不肖商人危害人民健康，民進黨立委管碧玲提案修正《食品衛生管理法》，加重相關罰則，以期有效遏阻食品業者不當添加行為，管碧玲的修法版本中，包括標示不符、摻偽等都提高罰金。管碧玲的《食管法》修法版本，除「行為犯」、「結果犯」外，也增加「危險犯」的刑責，意即現行法必須由消費者證明健康受危害，未來若修法通過，只要有致危害健康之虞者，都可處10年以下有期徒刑、拘役或併科1億元以下罰金。

至於致人於死者，管碧玲也擬由現行法處7年以上有期徒刑，得併科2000萬元以下罰金，提高為10年以上有期徒刑，得併科1億元以下罰金。
