未告知拒酒測罰6萬　拒測女獲判免罰

【劉志原╱台北報導】謝姓女子今年2月3日凌晨騎機車行經台北市艋舺大道，被警方帶回派出所做酒測，警方認為，謝女花了10分鐘做酒測費，吹了9次，仍無法成功，開出6萬元拒測罰單，謝女認為，警方當時沒有告訴她拒測會罰6萬元，提行政訴訟要求免罰。

台北地院認為，謝女的確拒測，但員警未告知罰則就開罰，程序有瑕疵，判她免罰。

判決指出，依大法官釋字第699號解釋，警方執行酒測勤務時，若當事人拒測，警方應先行勸導，並告知拒測後的法律責任，若當事人仍拒測，才可以開罰。
